The Supreme Court of India has constituted two special Election Tribunals to expedite the adjudication of disputes arising from State Bar Council elections. The decision was taken in response to a significant number of election-related grievances and challenges emerging from the ongoing State Bar Council elections conducted across the country.
A Bench led by Chief Justice of India Surya Kant and Justice Joymalya Bagchi observed that a dedicated mechanism was necessary to ensure timely resolution of election disputes affecting the functioning of State Bar Councils. The Court noted that prolonged litigation could hamper the administration of legal institutions and undermine confidence in the electoral process governing the legal profession.
Accordingly, the Supreme Court directed the constitution of two additional Election Tribunals. The tribunals are headed by former Supreme Court judges and are tasked with hearing and deciding election-related disputes arising from State Bar Council elections. Their establishment is intended to reduce delays and provide a specialized forum for resolving electoral controversies.
Following the Court's directions, the Bar Council of India notified the constitution of the tribunals. Election Tribunal-I is chaired by former Supreme Court Judge Justice Deepak Gupta, while Election Tribunal-II is chaired by former Supreme Court Judge Justice Hima Kohli. The tribunals also include former High Court judges and senior advocates as members.
The Supreme Court emphasized that the integrity of Bar Council elections is essential because State Bar Councils are statutory bodies responsible for regulating advocates, safeguarding professional standards, and representing the interests of the legal fraternity. Effective resolution of election disputes is therefore critical to ensuring smooth functioning and democratic governance within these institutions.
The move is expected to bring greater efficiency, transparency, and accountability to the electoral framework governing State Bar Councils. Legal observers have welcomed the initiative as a significant step toward strengthening institutional governance and ensuring timely justice in election-related matters within the legal profession.
