Delhi Court Reserves Order On Swatantra Bhardwaj's Bail Plea In CJP Protester Assault Case

A Delhi court has reserved its order on the regular bail plea filed by social media influencer Swatantra Bhardwaj in connection with an alleged assault case arising out of a Cockroach Janta Party (CJP) protest held at Jantar Mantar earlier this year.

Bhardwaj, who is currently in judicial custody, appeared before the Patiala House Court seeking regular bail. During the hearing, his counsel argued that the arrest was politically motivated and contended that the complainant was the actual aggressor in the incident. The defence relied on video footage and other material to support its claim that Bhardwaj acted in response to an attack initiated by the complainant.

The case relates to allegations that Bhardwaj assaulted Sanjay Kumar, the father of a minor CJP activist, during a protest at Jantar Mantar. The matter gained national attention after videos and statements concerning the incident circulated widely on social media.

The prosecution and counsel representing the complainant opposed the bail plea, maintaining that the allegations are serious and involve offences that warrant continued judicial scrutiny. The complainant's side disputed the defence's version of events and reiterated allegations of assault and caste-based abuse.

Delhi Police had earlier arrested Bhardwaj and subsequently added provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and criminal intimidation provisions to the case. Separate legal proceedings, including allegations under the POCSO Act, have also been reported in connection with the broader controversy.

The bail proceedings come shortly after the Delhi High Court declined to interfere with Bhardwaj's arrest, observing that his custody was pursuant to judicial orders and that appropriate remedies were available before the trial court.

After hearing submissions from all parties, the Delhi court reserved its order on the bail application. The matter is expected to have wider implications given the public attention surrounding the protest-related allegations and ongoing investigations.
