The Calcutta High Court has cautioned the West Bengal government that it may be compelled to pass a blanket order barring the registration of further FIRs against Trinamool Congress MP Abhishek Banerjee if the pattern of repeated complaints continues.

Justice Saugata Bhattacharya made the observation while hearing petitions filed by Banerjee seeking protection from multiple FIRs lodged against him. During the proceedings, the Court expressed concern over the repeated filing of complaints by individuals who had previously initiated similar actions against the MP.

The Court noted that judicial time should not be consumed by a continuous cycle of litigation arising from multiple FIRs based on similar allegations. It observed that if the trend persisted, the Court might have to consider broader protective measures to prevent abuse of legal process.

At the same time, the High Court clarified that any protection granted to Banerjee would not impede the ongoing investigations. The Court directed law enforcement authorities to continue their investigations and gather evidence in accordance with law.

The Court ordered that no coercive action be taken against Banerjee in connection with the three FIRs under challenge until November 30, 2026, or until further orders. It further directed that police must provide at least 48 hours' notice before requiring his appearance for investigation.

Banerjee was directed to cooperate fully with the investigation process. The Court also granted liberty to the State to seek modification or vacation of the interim protection if he fails to cooperate.

The matter highlights the judiciary's effort to balance individual liberty and protection from alleged misuse of criminal proceedings while ensuring that legitimate investigations are not obstructed.
