A Delhi court has sentenced former Aam Aadmi Party (AAP) councillor Tahir Hussain to two years of rigorous imprisonment and imposed a fine of ₹10,000 in a case relating to the February 2020 Northeast Delhi riots. The court observed that Hussain had used the position of responsibility he held as an elected representative in a manner that facilitated violence instead of helping maintain peace and harmony.
Additional Sessions Judge Parveen Singh of the Karkardooma Courts delivered the sentence on October 16, 2026, after Hussain's conviction for abetment of rioting. The court emphasised that his public position was an aggravating circumstance while determining the appropriate punishment.
Court Highlights Responsibility of an Elected Representative
The court observed that an elected public representative is expected to act as a restraining influence during periods of communal tension. According to the sentencing order, Hussain was expected to promote peace and prevent unlawful conduct rather than facilitate it.
The court found that his house, described as the highest point in the locality, had been made available as a location from which rioters could attack members of the public and damage property. It considered this finding significant in assessing the seriousness of his conduct.
The judge also rejected the argument that the absence of proof of Hussain's physical participation in the rioting mob substantially reduced his culpability. The court reasoned that facilitating or abetting violence can remain serious even where direct participation in the physical acts of rioting has not been established.
Conviction Under the Indian Penal Code
Hussain was convicted under Section 147 read with Section 109 of the Indian Penal Code (IPC), concerning rioting and abetment. The court acquitted him of the other charges in this case, which included allegations relating to mischief, arson and criminal conspiracy.
The proceedings arose from an FIR registered at Dayalpur police station following complaints concerning the looting and burning of shops during the February 2020 violence. The prosecution presented evidence concerning the use of Hussain's building during the rioting.
Separate Conviction in the Ankit Sharma Murder Case
This is Hussain's second conviction connected with the 2020 Northeast Delhi riots. He was previously sentenced to life imprisonment in a separate case concerning the murder of Intelligence Bureau staffer Ankit Sharma.
The present sentence relates to a distinct rioting case and should not be confused with the punishment imposed in the separate murder proceedings.
Legal Significance
The sentencing order highlights the relevance of abetment, the responsibilities associated with public office and aggravating circumstances in determining punishment for riot-related offences. It also illustrates that criminal responsibility for facilitating violence may be assessed separately from proof of direct physical participation in a mob.
