The Court observed that the rapid advancement of artificial intelligence technologies has enabled the creation and dissemination of manipulated images capable of causing serious harm to individuals. It noted that such content can spread quickly across digital platforms, leading to reputational damage and emotional distress.
During the proceedings, the petitioner argued that the image was fabricated using AI tools and circulated online without consent. The petitioner sought urgent judicial intervention to prevent further dissemination of the content and to safeguard personal dignity and privacy.
Recognizing the potential harm caused by deepfake and AI-generated content, the Court directed the concerned intermediaries and online platforms to remove the image and take necessary steps to prevent its continued circulation. The Court reiterated that technological innovation cannot come at the cost of fundamental rights, including the right to privacy and reputation.
The matter adds to the growing body of Indian jurisprudence addressing AI misuse, deepfakes, and online harms. It highlights the judiciary's increasing focus on balancing technological advancement with individual rights in the digital age.
The case also underscores the need for stronger safeguards and compliance mechanisms by digital intermediaries to address non-consensual synthetic media and other forms of AI-enabled abuse.
