Resigning from a job does not end an employer's financial obligations toward an employee. One of the most important post-employment processes is the Full & Final (F&F) settlement, which ensures that all dues owed to an employee are cleared after separation.

Under Indian labour laws, an F&F settlement typically includes unpaid salary, leave encashment, bonuses, incentives, reimbursements, gratuity (where applicable), and other contractual dues. Employers may also make lawful deductions for notice pay recovery, unreturned company assets, advances, or tax liabilities.

The introduction of the Code on Wages, 2019 has brought renewed attention to settlement timelines. The law requires wages payable upon resignation, termination, dismissal, or retrenchment to be paid within two working days of the employee's last working day. This provision seeks to reduce delays that have historically affected departing employees.

However, legal experts note that the two-working-day rule primarily applies to wages and may not automatically cover every component of an employee's overall F&F settlement. Certain payments, such as gratuity, incentives, or reimbursements, may require verification and separate processing.

Employees can facilitate a smoother settlement process by completing exit formalities, returning company property, clearing outstanding obligations, and ensuring that all documentation is submitted before their last working day.

Transparency remains a critical legal requirement. Employers are expected to provide a clear breakup of payments and deductions. Unjustified withholding of earned wages or statutory benefits may expose employers to legal challenges before labour authorities.

As labour law reforms continue to standardize employment practices across India, the emphasis on timely settlement of employee dues reflects a broader effort to strengthen workplace rights and improve compliance among employers.
