The Madhya Pradesh High Court has delivered a significant ruling aimed at curbing the indiscriminate freezing of bank accounts during cybercrime and fraud investigations. The Court observed that blanket freezing of entire accounts often causes severe hardship to individuals and businesses, disrupting legitimate financial activities without adequate legal justification.
The matter arose from petitions filed by account holders whose bank accounts had been frozen following cyber fraud alerts and communications from law enforcement agencies. In several cases, the freezing orders prevented account holders from accessing funds unrelated to the disputed transactions.
Justice Subodh Abhyankar emphasized that investigative agencies must adopt a proportionate approach. Rather than freezing an entire bank account, authorities should identify and secure only the amount allegedly linked to the suspected fraud. The Court directed banks to segregate disputed sums into fixed deposits or similar protected mechanisms while permitting normal operation of the remaining account balance.
The Court further stressed that investigative agencies must comply with the procedural safeguards prescribed under the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), including timely reporting to the competent Magistrate. Failure to follow statutory procedures could justify the release of frozen funds.
Criticizing the routine use of account freezes based solely on cyber alerts, the High Court noted that freezing an entire account can effectively paralyze an individual's or business entity's financial existence. The Court highlighted that such measures must be exercised sparingly and only when supported by legal authority and necessity.
The ruling is expected to provide relief to businesses, professionals, and individuals who have increasingly faced account freezes in cyber fraud investigations despite having no direct involvement in the alleged offences. It also reinforces constitutional protections relating to livelihood, trade, and access to property while preserving the ability of investigators to secure disputed proceeds.
Legal experts believe the judgment could influence similar cases across the country and contribute to the development of standardized safeguards governing account-freezing practices during criminal investigations.
