Delhi High Court Directs Wrestling Federation to Decide Vinesh Phogat's Show-Cause Notices Within Two Weeks
The Delhi High Court has directed the Wrestling Federation of India (WFI) to decide two pending show-cause notices issued to wrestler Vinesh Phogat within two weeks, taking note of concerns that prolonged disciplinary uncertainty could affect her preparation for upcoming sporting competitions.
Justice Amit Mahajan passed the direction on October 29, 2026, while hearing a petition filed by Phogat challenging the show-cause notices dated May 9 and June 17, 2026, along with the consequential disciplinary proceedings initiated by the federation.
Background of the Dispute
Phogat approached the Delhi High Court seeking to challenge the disciplinary action initiated by the WFI. She contended that the notices and subsequent proceedings were arbitrary, mala fide and influenced by extraneous considerations.
The two notices relate to allegations concerning indiscipline, anti-doping compliance and other disciplinary issues. Phogat has maintained that the proceedings could adversely affect her return to elite-level wrestling and her eligibility, nomination and participation in future competitions.
During the hearing, her counsel, Senior Advocate Rajshekhar Rao, submitted that Phogat intended to participate in a national wrestling tournament scheduled for around mid-December 2026. He argued that the unresolved notices created uncertainty while she needed adequate time to prepare for the competition.
Delhi High Court's Observations
The Court noted that no final decision had yet been passed on the two show-cause notices and that there was presently no impediment to Phogat's participation in upcoming tournaments.
However, the Court acknowledged her apprehension that an adverse decision shortly before a competition could leave her without sufficient time to seek appropriate judicial relief.
Observing that her concerns appeared genuine, Justice Amit Mahajan emphasised the importance of an athlete's mental preparedness, stating:
"A Sportsperson has to be in a fit and relaxed state of mind to participate in any competitive event of such nature as indicated so that their performance is not compromised in any way."
What Did the Court Direct?
The Delhi High Court directed the respondents to take a decision on the two impugned show-cause notices within two weeks.
The Court further clarified that if a decision is taken after the expiry of the two-week period, it shall remain in abeyance until the next date of hearing. This direction provides interim protection against the immediate operation of a delayed decision.
The Court also issued notice to the respondents and directed them to file their replies, if any, before the next hearing.
Next Hearing
The matter has been listed for further hearing on January 20, 2027, before the Delhi High Court.
Legal Significance
The order highlights the importance of timely decision-making in disciplinary proceedings, particularly where unresolved administrative action may affect an individual's professional opportunities. It also demonstrates the Court's willingness to consider the practical consequences of prolonged uncertainty while exercising its writ jurisdiction.
However, the Court has not finally determined whether the show-cause notices or the disciplinary proceedings are legally sustainable. Those issues remain subject to further consideration.
