The High Court of Jammu & Kashmir and Ladakh has granted anticipatory bail to a police Sub-Inspector accused of sexually exploiting a woman constable by allegedly inducing her into a sexual relationship through repeated promises of marriage.
The case arose from allegations made by the woman constable, who claimed that the accused officer continued the relationship over a period of time while assuring her that he would marry her. According to the complaint, these assurances were used to maintain the relationship despite the absence of any concrete steps toward marriage.
The anticipatory bail application came before the High Court in Vikrant Kotwal v. Union Territory of Jammu & Kashmir. While considering the plea, the Court evaluated the nature of the allegations, the relationship between the parties, and the circumstances that led to the registration of the criminal case.
The Court observed that the material placed before it required a detailed investigation and that custodial interrogation of the accused was not immediately necessary at the present stage. Taking note of the facts and circumstances, the Court granted anticipatory bail subject to conditions and directed the accused to cooperate with the investigation.
The ruling highlights the judicial approach in balancing the rights of the accused with the need for a fair and effective investigation, particularly in cases involving allegations of sexual exploitation arising out of relationships allegedly based on promises of marriage.
